【内容摘要】德国巴伐利亚州立图书馆藏契约文书的特征有如下几个方面：文书类别以土地田房买卖契约为主，集中反映了当时社会经济的流通情况；文书性质多为经官府认可的红契，保存比较完整；文书内容的程式性强，行文结构完备，语言朴素，有防伪意识；地域分布较为零散，不同地区的文书存在书写差异，也具有明显的地域特征；年代集中于晚清至民国年间，少数文书与历史事件有关。以巴伐利亚州立图书馆藏契约文书数据库的建设和田野作业方法为支持，对相关契约文书补充了其归户信息。将契约与地方社会的联系作为关注焦点，至少可以显示出两个方面的特征，一是契约的交易规范与乡土社会的关系非常密切；二是契约中所体现的家族观念，是人们立契时价值选择的中心。

Research on Chinese Contracts Documents in the Bavarian State Library from 

the Perspective of Folklore

Abstract: Characteristics of the contact documents in Bavarian State Library in Germany, include the following aspects: The documents primarily consist of land and property purchase contracts, reflecting the economic circulation of the society at that time. The nature of the documents is mostly officially recognized red contracts, which are relatively well-preserved. The content of the documents is characterized by strong formality, complete textual structure, simple language, and anti-counterfeiting awareness. The distribution of the documents is relatively scattered, with different writing styles across different regions and obvious regional characteristics. The documents are mainly from the late Qing Dynasty to the Republican Era, with a few documents related to historical events. With the support of the construction of the database of contract documents in the Bavarian State Library and the fieldwork methods, the relevant contract documents have been supplemented with their ownership information. By focusing on the connection between contracts and local society, at least two characteristics can be revealed: Firstly, there is close relationship between contract regulations and local communities; secondly, the concept of family reflected in the contracts is the center of value choice of the individuals when entering into contracts.
